When a parolee is arrested for a new low-level crime, prosecutors often let parole handle it. Why? They are already under parole supervision and have far less rights than you or I. On parole violation you get held in custody with no bail, on case, generally entitled to bail. /2

On a case, you have all of your constitutional rights, including the right to a jury trial. Anyone want to do jury duty in a pandemic? On parole, you just get a hearing, everyone gets violated. Most people admit a violation for a set period of incarceration. /3

On a parole violation the standard is preponderance of evidence or more likely than not, anything greater than 50%. For a criminal case, you need to be able to prove the case beyond a reasonable doubt to 12 jurors. Highest burden in our justice system. /4

For these reasons and more, letting parole handle low-level offenses is standard procedure. It's a question of resources and efficiency, which all DAs have to consider. This isn't a Chesa thing, this is a criminal system thing, even in the most extreme pro-trump counties. /5

All I care about is that two innocent people are now dead because @chesaboudin should have locked up that criminal and didn’t.
Why? Because Mr. Boudin is an ideologically blinded person who has more sympathy for the criminals than for their victims. Shame!
