True, while that doesn’t require a lot of work it does alter the base content to create something new. I assume that would be a grey area for fair use, Maybe if the person was commentating over it would be better.

fairuse to me is a bad law as it encourages the meaning of using someone, you're taught not to use people the law fairuse protects the people who does it, like if someone takes a picture i took in a game for clickbait content (it happened) thats fair use i can't say anything

That’s not at all what fair use encourages. Fair use encourages the critique, reporting, and altered content. As for someone taking your photo that you took in a game that’s something that’s entirely complicated because who’s to say you should have the rights to that photo?

Did the game developers give you permission to take the photo and use it for yourself? Did it feature identifying characters of your own? Who’s to say the person didn’t take a very similar photo?

this happened yeard ago people took pictures from my channel for clickbait videos one even admitted to doing it, stealing thumbnails from other videos is technically fair use i have seen big youtubers complain about it though but only when they didn't do it

Im not good with law, but i dont think that is fair use. Stealing other people thumbnail, meaning stealing other people work (unless it just a random clip from a game that has no edits)
