    I was really looking forward to arguing this case, so although I am excited to watch the argument livestream tomorrow - to Con Law nerds like me, this is a super interesting case - it will be bittersweet to hear someone else stand up and say "May it please the court..." /5

    When, if ever, can the circuit court refuse a private citizen petition? While I was at WV AG's office, I wrote the brief on behalf of the State of WV. You can read the brief I wrote here: /3

    In the 80s, the WV Supreme Court held that the "Open Courts" provision of the WV Constitution, Art III s. 17, allows private citizens to petition to appear before the grand jury to seek a criminal indictment. The case before the Court tomorrow asks an important question: /2

    Want to say now, while I still can, that I am very proud of the work I did in Carmichael v. Workman (cert petition related to the SCAWV Impeachment saga), and that I hope SCOTUS takes the case in the fall. My only regret is that I wouldn't be around to litigate the merits!

    Anyway, thats probably enough for one thread. I'll put a bow on it by repeating the obvious: the WV AG's office is awesome, I was tremendously lucky to spend 4 years there, and I cannot recommend the job or the people still there highly enough!!! /end

    ( should pay *very* close attention to that last one, which has understandably flown under the radar, because given certain . . . circumstances . . . in the national political climate, SCOTUS might be more interested in Carmichael than it would be otherwise) /12

    (Disclaimer: I spent around half my time in the Office's dedicated criminal appellate shop, so my numbers are inflated by my tenure there. Nonetheless, the chances for multiple OAs are still very high!) /8

    What if I told you that at the WVAGO there is a high likelihood you will have *multiple* chances to present oral argument before a court-of-last-resort? What if I told you that in a little under 4 years, someone (read: me) presented oral argument in the SCAWV 20 times!!! /7
