        It wasn't a statute. But it was an official policy position by a federal agency (DHS), which makes it subject to the requirements of a statute (the Administrative Procedure Act) and subject to judicial review (via §706 of the APA).

        I'm not talking about it's judicial review, I'm talking about the interpretation of the policy ending being unlawful when the policy itself is unlawful to begin with.

        Yes. It's irrelevant to the issue the court was considering. The lawsuit was not challenging the legality of DACA. It was challenging the administrative process by which DACA was rescinded. That's all. So, the agency's legal reasoning was relevant, but not the legality per se.

        And part of the administrative process for recension included reasonings of legality finding it " ...did not comply with the [APA] because the Department did not implement it through notice-and-comment rulemaking.” Which is also the challenge against the recension actions. 🤔
