The same law clearly states that the President shall appoint the Director ... so how can the director appoint his successor. If the Director is sick, if he is on vacation, if he is on business overseas .. that's when he can put his Asst. Director in charge until he returns.

To me the law is clear ... The Acting Director can only act as Director if the Director is absent or unavailable. The guy resigned ... he is not absent or unavailable. He left ... the Pre. can appoint whomever he wants ... this is a no brainer, but liberals always twist things.
