The creditors filed an involuntary petition pursuant to 11 USC 303. The court enters an order for relief, but the petition starts the case.

does the petition alone constitute a bankruptcy or does a judge then have to act upon it and to enforce the status?

In a voluntary case, the petition automatically causes an order for relief. In an involuntary, the debtor can accept or fight.

Either way, they are a debtor in bankruptcy upon the filing of the petition. Then the case either continues or is dismissed.
