        Of course the have. Smaller and more nimble ships are obligated to steer away from larger and more cumbersome ones.

        Maybe, does not matter, a smaller more agile ship are supposed to make way for a larger not so easily controlled ship.

        Understand the "rules" but I would expect that the cargo ship would have used all available means to communicate with the destroyer.
