It's pretty much going to take a Constitutional Amendment for that to happen, right?

There are ways of getting around the 14th Amendment without further ado. Open boarders, free trade & dual citizenship could make the process already constitutional IMHO. But an act of Congress is likely still necessary though not a Con. Amendment etc.

Right now there's no real mechanism for secession, and the 14th Amendment is more about due process, equal protections, and citizenship. What part of the 14th are you referring to, specifically?

I see the 14th Amendment as the primary way to prevent CA Independence if it is done property because of the following reply tweet. What do you see as the primary way? Why do you think a Constitutional Amendment is needed?

I feel an Amendment is the best way primarily because it supersedes a Presidential veto and it cannot be overturned by SCOTUS. An amendment solves the problem, and if put to vote, esp. with CA being unpopular in at least 35 states, could pass a referendum for ratification.

Passing a constitutional Amendment will be even harder than anything else due to the need to get consent from the states that all profit form how the
#US picks our pockets. We need POTUS approval anyway because if we don't have it our American friends could just invade.3 vastausta 0 uudelleentwiittausta 0 tykkäystä -

Actually, the big hurdle is Congress, because they would have to approve it to put it to direct referendum per Article V. And if it does pass referendum, then the President would be bound by the new amendment as law and SCOTUS would have to uphold it. (more)

But a peaceful and democratic process will take time, so we'll escape via whatever route is less packed as the building burns whether a window, a door, or a hole in the wall...
