The 1995 Crime Bill (passed with strong bi-partisan support) is the more direct and consequential stimulant of the problem you've highlighted. State of GA has done some excellent work in systemic prison reform. Look there for some ideas (that haven't had much national attention).

The problem is that anyone would be arrested for marijuana in the first place. It is even more ridiculous that taxpayer money is wasted to imprison anyone convicted of a nonviolent, non-sex crime, when a fine and ankle bracelet/monitoring would suffice.
