South Dakota, for example hasn’t adopted a newer version of FDA food code since 1995. California has never adopted the model FDA food code. Some states have multiple jurisdictions, so food safety code is determined at county and city levels.

Also… worth noting that states DO have jurisdiction over food safety law. The FDA food code is purely a model food code that the state can choose to adopt or not. Some states do, some don’t.

There are some things that you just can’t leave to states, as the inconsistent application of rules makes national commerce VERY challenging. (FWIW, in the last CFP we formed a committee to address food code relating to sushi rice and expect to standardize soon).

A large sushi operator was dealing with this headache. The disjointed regulations made it difficult to expand, and even more difficult to operate efficiently.

Take sushi rice, for example. There is a gap in the current food code on storage of acidified rice. So states filled in their own rules. A company trying to operate a National chain of sushi restaurants has to develop 17 different operations processes to make sushi..

There’s a BIG problem with this approach. Without a national food safety code put out by the FDA, states adopt non-science based and incongruent rules. Further, the differences in regulations across jurisdictions makes it a challenge to operate multiple restaurants.
