I understand it's unwanted by some people - but you're kind of stretching the definition of malware.

From Wikipedia: Malware[...] is any software used to disrupt computer operations, gather sensitive information, [1]

[1] gain access to private computer systems, or display unwanted advertising.

The telemetry does at least one of this. Windows itself does all.

Telemetry - which you'll find even in pre-MS Minecraft - is industry standard.
