The main problem is that a lot of the armchair morons think that trademark generalization requires the big N (or anyone else) to agressively shut down any and all fan works, lest the big company magically lose all rights to their own IP

however, the big N and friends have a vested interest in keeping fangames out: competition a fan's incredible well-made remake of metroid 2 might detract from sales of the "official" one. can't have that.

Putting aside my view - which is that a team capable of making an incredibly well-made remake of Metroid 2 should be equally capable of making an equally compelling game that doesn't get an inherent publicity boost by using the Metroid name - I suspect you're right.

I disagree w/ the idea that it could be equally compelling. Having an original to compare against matters a lot, as it gives a baseline for changes, improvements, and other things it's also a "if I wanted to make something new, i would" thing

I suppose this is the point on which we might never agree. Where you see an "if I wanted to make something new, I would" thing, I see a "riding on coattails" thing. It's fine if that's a person's thing, but the hero-worship surrounding these fan games baffles me.

Where did "hero worship" come from? Like, I don't get it. You make a fan game because you want to reuse the setting, characters, designs in a different way. It's derivative work 101.

It seems like we're largely on the same page as far as what the fan game itself is, then. What I'm saying I don't understand is the inevitable sea of publicity that comes from it. I mean I *do*, I just object to it because it is, as you say, a derivative work.

To tie back into the whole fanfiction concept, in an admittedly sarcastic way: Even the most well-written Harry Potter smut is, at the end of the day, simply Harry Potter smut.

And some people want it. That doesn't change the fact that it should be fine to make or that JKR would be (even more of) a huge piece of shit for ordering takedowns of it.

Absolutely, and I appreciate you taking the time to clarify the underlying legal issue, or rather that there isn't an underlying legal issue. I'll probably still dunk on such things in the future, but at least I can be more honest that there is no legal basis for my gripes.
