the tetris company is bad.
Putting aside my view - which is that a team capable of making an incredibly well-made remake of Metroid 2 should be equally capable of making an equally compelling game that doesn't get an inherent publicity boost by using the Metroid name - I suspect you're right.

I disagree w/ the idea that it could be equally compelling. Having an original to compare against matters a lot, as it gives a baseline for changes, improvements, and other things it's also a "if I wanted to make something new, i would" thing

plus there's the issue of tetris games tetris is a very, very basic game, with fairly simple rules. you can't really change up the design too much while still keeping the same gameplay

After giving it another read through, it looks like the important phrasing in the Lanham Act 15 U.S.C. § 1125(a)(1) would be "uses in commerce" - which the team would be completely clear of if their fan game is entirely public domain.
