I'm interested in your insights as to why Nintendo's killing of fan games based on trademarks is legally wrong (because I'd agree it's morally wrong).

Also, I realize the above request can come off as trolling so: Full disclosure, I've been an ardent critic of fan games for a whole host of reasons, the legal implications being one of them, but I would rather not argue from an incorrect standpoint. So I would welcome correction.

The main problem is that a lot of the armchair morons think that trademark generalization requires the big N (or anyone else) to agressively shut down any and all fan works, lest the big company magically lose all rights to their own IP

granted, i am also an armchair moron, but: this is not the case, this has never been the case. if that was true the concept of fanfiction would be dead overnight
