I have about as much tolerance for this "But we should be able to use Nintendo's IP however we want!" pearl-clutching as I do those jackasses who make Pokémon "fan games" and then act all aggrieved when they get a Cease & Desist letter. Not even being sued, just C&D'd.

Gonna veer off-topic here and just rant about these "fan games" for a bit. Look, y'all clearly have capable coders and and (maybe, since they're basing their work on existing assets) artists, can you just, like, not simply make an indie game?

No, really, my bad. I forgot that a company that's spent the past 20+ years cultivating a brand should be perfectly okay with people using that brand as a pivot point to promote their own fly-by-night, creatively-empty goals that wouldn't exist without some other fucker's ideas.

And even then, I'm of the opinion that anything not actively being developed for ~20 years should automatically be returned to the public domain. If you don't use it, you lose it. But these companies are actively using it, and have been for years, so what's the excuse?
