Don't see how. Copyright is issued based on filing date or creation date, not based on release date. Virtual Console titles are binary-identical to what you'd use with an emulator, including using the iNES container format in the case of NES titles.

That said, thanks to Disney, the soonest one can expect any NES titles anyone actually cares about to be in the public domain is between 2050 and 2060.

Regardless of how you feel about Disney being entitled to longer copyright or not, maybe we need to make an exceptional copyright that's longer and can be continued, instead of all things being locked behind Mickey forever.

...5 years after nobody is making money with it, providing fixes/updates/repairs is ok IMHO. Either actively support the product, or let it go. But don't lock it away and let it rot in the "IP basement".

Still way too short. If someone invested the time and money into building something up, it shouldn’t fall into the public domain in under a few decades. Or watch Disney jump on every IP they can for a buck.

Just because an IP is locked up, it doesn’t prevent others from inventing their own IP. I never understood why people lock on to something and refuse to move on to something new. It sucks Robotech IP is locked up in a dungeon, but someone can still create a new transform mech IP

Probably for the same reason that people make mediocre unlicensed Pokémon RPGs and Metroid games that "somehow" end up being wildly popular: Being original is haaaaaard.

Not saying that you're one of those people, Andre, just that it always has rubbed me the wrong way when people do that, and limiting IP to such a short period would effectively ensure that instances of such behavior would be made manifold.
