@OortClouder I keep telling ya man, something isn't inherently public domain just because it's old and not actively distributed or promoted by its rights-holders. Quite the opposite: Copyright is inherent. It's trademark that has to be actively litigated to be maintained.

If we're going to play the pedantry game, I'll be more exacting in my words: If someone is using your registered mark in such a way that violates the Lanham Act, then you risk having your mark invalidated due to dilution. Better?

I don't believe I was arguing that anyone was harmed by trademark dilution. In fact I believe the whole copyright and trademark system needs to be razed to the ground and rebuilt in a severely limited form.

Right there with you, man. There's pretty much zero need for YouTube to be as asinine as they are about cheesy, obscure slasher flicks from the late 70's that a group of like 20 folks are just watching to laugh at and riff on, but they are, and it bites.
