Perhaps collecting polling data to see if popular opinion favors it or not? If that data shows people will or won't support it...
...an argument could be made on that basis. That argument would not really be whether or not it's bad, but instead how folks feel about it.

In terms of a strictly logical sense (every instance of censorship is bad)--I don't think you can make a case without cherry-picked data.
