Since voter approval can exceed that number it is ONLY a cap if you figure the voters are fed up with crushing property taxes and overspending.
If the budget officer - usually an auditor - has to certify the budget of a taxing unit before it goes into effect, how can that officer certify the budget at the start of a fiscal year if part of that budget is contingent on an election held later? Looks and acts like a cap.
