I think it's very important to realize that you nor I have all the facts, since most of it for obvious reasons remains private between the involved. Its up to each TO to decide if they respect the Code of conducts decisions, not some twitter hashtag.

Having bans be up to individual TOs makes every problem you pointed out worse. It is far far less objective overall, more work for everyone, makes it more of a popularity/outrage game, biases decisions towards the TOs' own personal interests instead of justice, and so on.
