Justice Thurgood Marshall knew well that the 14th Amendment wasn’t “self-fulfilling,” but that it fell to all of us to make it real: “The 14th Amendment and its grand ideal of equality under the law have meant no more than succeeding generations were willing for them to mean.”
Justice Marshall continued: “Without committed action by committed individuals, without persistent use of the legal and political tools created in 1868, the amendment could not be expected to match its promise.”
Even after winning the landmark Brown v. Board of Education and ascending to the nation’s highest court, Justice Marshall was acutely aware that continued “activism in the pursuit of justice,” the same kind he championed, was crucial to fulfilling the 14th Amendment’s mandate.
