    I’m as critical of Kennedy’s votes as many (and have another very critical piece out Monday ) but there’s nothing to suggest Justice Kennedy did his job with anything but the utmost integrity.

    The replies to this are incredibly depressing to me. What's happened on the right is bad, but man the left needs to get its own house in order.

    Except that barring (by regulation) those who enter the US unlawfully from pursuing otherwise valid asylum claims would violate a federal statute (8 U.S.C. § 1158(a)(1)); the Fifth Amendment's Due Process Clause, and at least three different treaties to which the US is a party...

    Many Central American asylum seekers—including families—enter the US between ports of entry. Under Trump, they’re being prosecuted for illegal entry. Now the DOJ is proposing a rule that would bar them from asylum.
