Thread: I want to clarify 2 important #vaping misconceptions. 1) The @US_FDA proposed action on vaping is NOT a flavor ban. 2) E cigs/ vaping are NOT legally recognized as a smoking cessation aide in the US- because the vaping industry hasn’t applied for approval as such.

However per the law and the deeming rule, any company can apply to the FDA for approval of vape products – including flavors. So from a federal standpoint, THERE IS NO “BAN.” If manufacturers/ retailers/ consumers want continued access, submit an application & make the case.

Vaping is a multi billion $ industry (much of that
made selling to kids). If one really believes these products help people quit, it would be best for all if that
funded US studies & applications for approval as Congress dictates, vs lobbying for continued illegal access.Show this thread -
As USSG I want to find the right balance - between the data and science on all sides, and the law. 1st we must strive to follow the law as Congress dictates. 2nd we can’t ignore proven epidemic youth use. 3rd, must make the science (in US environment) & legal cessation case.

So to vaping industry/ retailers/ advocates/ researchers- collect the data, do/ fund the studies, & make the proper legal case as the law requires. But asking
@US_FDA to not enforce/ allow continued illegal (per@FDACommissioner) access when youth are harmed isn’t reasonable.Show this thread

The FDA's entire deeming regulation was a ban on vaping products because they knew 95%of the market wouldn't be able to afford the testing to get approved. Instead of going the EU route with a TPD style regulation which controls what is in the product and how it is marketed.
-
Furthermore, the FDA has been working on the guidelines for application process for the ENDS industry until earlier THIS Summer! So no one could apply before then! The products aren't illegally on the market, they are allowed on the market by the FDA until the PMTA deadline.

'(which now almost no one denies)' no-one could deny that by the recording methods youth experimentation has increased, however that is far from *use* which has a multitude of meanings to all and sundry=> wide misunderstanding in media + public *use* 1-2 puffs counts as use!

Kids want the head high, easy access and availability of THC of POD or CARTRIDGE devices with the high nic content. They don't care about the flavor.
