All it takes is the supreme court to command them to send them. It's actually what they're supposed to do if the house tries to pull this. Holding them is a violation of the constitutional impeachment process.
That is not clear. There is no time limit in the Constitution, only limits as to who impeaches (House), who conducts the trial (Senators), and who is the judge (CJ SCOTUS).
On the legal side what happens when a person is indicted but the Prosecutors doesn't bring it to trial? Is there a legal precedent on how long they can sit on an indictment?
