Mugshots are public records - and everyone should understand this anyway, but the website itself makes it very clear that a mugshot is not proof of guilt, or even that a crime has actually been committed. This whole thing seems like a cash grab by CA's scum bag attorney general.
-
Not really. Every state has laws regarding a person’s privacy which Mugshots fall under. There are also restrictions on how someone else’s likeness can be used, specifically to prevent slandering or sabotaging people in much the same way angry leftists dox political dissenters.
-
Nope. If states have those laws, they are invalid. They violate fundamental principles of open and transparent government. ...and a mugshot is not a "likeness." It is literally a picture of the person.
-
... First off, a picture of a person is literally the basic example of "A likeness of a person". Second, no it's not a violation of open and transparent government. People have a right to privacy, that includes mug shots. This is why state and federal laws allow the limitations.
-
A photograph is not like how a person looks. It literally is how he looks. A mugshot is public record. No one has the right to suppress information about govt activity. It doesn't matter if laws say otherwise. Citing them isnt an argument. It's just an appeal to authority.
