        Congress only has to declare war if what the President is doing is going to take longer than 90 days. An airstrike did not take longer than 90 days.

        POTUS does NOT need congressional approve for military strikes. He is Commander-in-Chief. He has the power to levy war. Congress has the power to declare war. You dont need to be in a state of war to use military force & you dont need to use military force to be in a state of war

        He is commander in chief AFTER a declaration of war by congress.Until then constitutionally he is not given that power. Read your constitution. Article1section8 clause 11 & Article 2 section 2. Past precedent doesn't make it legal just highlights our failure 2 follow our own laws

        Madison and Gerry debated this. Since Congress is not in session every day of the year, they were concerned about the President not having the power to use military force to repel an attack. To remedy this, they switched "make war " to "declare war" in Article 1 Section 8.

        This effectively gave the President the power to levy war without Congressional approval. If Congress has an issue with the President's war-making decisions, they can either stop allocating funds to the military or impeach and remove the President.http://history.house.gov/Institution/Origins-Development/War-Powers/ …

        The whole reason 2 put congressional approval was specifically the executive branch was most prone 2 war.Effectively is code for he doesn’t but we’ll write in gray area.Prez does NOT have power. Militia is NOT the standing armed forces. He had congress in session no excuse

        It was a compromise that was made. The change from "make" to "declare" in Art 1 Sec 8 limited Congress's powers & left the President w/ all the war-making powers according to Art 2 Sec 2. Whether Congress is in session or not is irrelevant. The text permits him. You are clueless!

        This is the logic you get when there is total lack of critical thinking and understand of plan english. In order for military force to be used CONGRESS MUST declare war. AFTER that declaration and their funding approval THEN the president is incharge of DIRECTING it.
