I agree with you on many things, but incitement is the act of telling someone to do something. Burger King is clearly endorsing violence in their tweet, but they never actually tell anyone to throw a milkshake. Thus the legal standard of incitement is not met.

By doing this, they are showing that they are just a restaurant that is better at avoiding crimes than they are at making fast food or having a halfway decent philosophy of political engagement.
