Technically if Smollett had paid then to beat him up then they can’t be charged with a crime
The bodybuilders knew of the fraud when Jussie reported the attack as true. People with knowledge of a crime have a duty to report, no?

Yes but prosecutors have full discretion when it comes to filing charges. For example if a woman was routinely physically harmed by her husband and she eventually one day she snaps and shoots him the prosecutors could look at the totality of the evidence choose not to file charge
