Yes but prosecutors have full discretion when it comes to filing charges. For example if a woman was routinely physically harmed by her husband and she eventually one day she snaps and shoots him the prosecutors could look at the totality of the evidence choose not to file charge

I’m a police officer and can shed some light here. Smollett is the one that filed the report with CPD. There is (presumably) a state code outlining the illegality of filing a police report that you know is false. The brothers, though participants with Smollett, didn’t lie to PD

Where I think the brothers could be in hot water is the letter, it had a powdery white substance in it, that is enough to rack up a terrorisim charge.
