Allegedly Smollett paid the two men to fake the crime - they agreed to this. Also they're of Nigerian descent, not white (although Smollett claimed otherwise) Disorderly conduct? He's been charged with falsifying a police report, 3 years in prison minimum.

That should come from the District Attorney. Commissioner just submits the evidence from the investigation. There is a grand jury being convened, i hear. But I am not holding breath for anything beyond community service.
