Not in this case. In this case, with things being as unstable as they are, this could have triggered a race war, with people ending up dead. That's way more serious.

There are tort remedies for this. People should learn them or consult an attorney.

Just imagine if there had been two innocent white guys in maga hats walking nearby who got arrested for this. They would have been strung up on bogus charges and made out to be public enemy number one and given decades in jail.
