If you come at someone with a criminal accusation, and it turns out to be false, you should get the jail time they would have received if guilty.

How do you distinguish between false and unproven?

Don’t make accusations you can’t prove, simple as that.

Then a lot of rapes wouldn’t get reported at all. Don’t know about you, but I would like all rapists reported,* even in he said/she said situations. The burden of proof for showing someone lied should be the same as for the original allegation. *Preferably not 36 years later.

Hopefully tech will fix this, there is some pretty neat lie detection stuff going on with brain scanners i think

Could still get he thinks/she thinks situations, where each truly believes his/her own version of the story. That’ll be interesting.

Lie detector tests are no longer admissible as evidence in court. Regardless whether it happened or not, this case can not be proven at this time. Even the possible witnesses are compromised after 36 years. No prosecutor will take this case. They like winning their cases.

NO. Though there needs to be a deterrent to false accusations, incarceration is far from a civilized punitive action. Community service, a public apology, and personal liability insurance would be more fitting.

Agreed, a person making false accusations should face a heavy penalty for trying to ruin someone's life. Giving someone a light sentence won't stop this. Some woman in the UK is serving a 10-year sentence for falsely accusing a man of rape.https://www.theguardian.com/society/2017/aug/24/woman-jailed-10-years-false-rape-claims-jemma-beale …

Interesting that she got a longer sentence for lying than most men get for raping.

Well an average sentence for rape in the UK is 8-9 years. Makes sense she would have another year or two tacked on for waisting taxpayer money and ruining innocent people’s lives.
