Don’t make accusations you can’t prove, simple as that.
If you come at someone with a criminal accusation, and it turns out to be false, you should get the jail time they would have received if guilty.

Then a lot of rapes wouldn’t get reported at all. Don’t know about you, but I would like all rapists reported,* even in he said/she said situations. The burden of proof for showing someone lied should be the same as for the original allegation. *Preferably not 36 years later.

NO. Though there needs to be a deterrent to false accusations, incarceration is far from a civilized punitive action. Community service, a public apology, and personal liability insurance would be more fitting.

That's an interesting take. Utterly insane, but interesting. Attempted sexual assault: Go to jail. Attempting to have AN INNOCENT PERSON incarcerated, ruining their lives and subjecting them (undeservedly) to the horrors of prison: Work in a soup kitchen.

If it is proven, beyond a reasonable doubt, that you deliberately falsely accused someone, then yes. It is a crime & you should receive the punishment you attempted to inflict upon them. But an unproven allegation is not the same as a proven, false allegation.
