I'm not a betting man, but the exemption was for 'microenterprises and small enterprises', not SMEs (which includes some relatively large ones). Not that I personally support any exemption, but I'm not involved in the process.

I'm pretty sure that if you had it your way, European rightsholders could fly over to America and sue any website they want, even if all of their employees and servers and such reside in the US. Forcing us to follow the EU's laws even though they're not our laws.

If I had it my way, the DMCA would remove their Safe Harbor clause, replace it with provisions like Article 13, and they could be sued under US laws.

But yet, the biggest problem here is that the free content producers will have to have mechanisms of averting copyright fraud
Those mechanisms are costly
In #FOSS, we would have Linux Foundation handle that for billions of small projects, so that we would be safe
