          They can, at worst, 'outsource' the surveillance to private companies (which already do this with impunity) and then vacuum it up to bypass ruling/s, or only fetch metadata from "big data"

          Cowardly? No a coward is an oath breaker. Up holding your oath to the US Constitution and your responsibility to the people in the face of the threat of the oath breaking establishment is the opposite of cowardly. You just have your head too far up your ass to see it.
