How you can defend someone who takes peoples content without asking them, offering no transformative additions and monetizing all of it for personal gain is beyond me, and it's disgusting. But at least I understand why now.
I agree, all the highlights I do, I get permission to do so or in the case of xd1x he asked me to go ahead and do some. Most of the time I donate to the streamer with part of the money I made from the video(s) monetization

Surprised to learn about the speedrunfails issues from your tweets. GlitchPhD asked to use one of my clips in August. Sad to hear they didnt give everyone the same courtesy, was it laziness? I gave them a few clips as I was flattered to be included and it was nice to get noticed.
Laziness and I think probably has a lot to do with producing the videos and asking while or after - if people didn't respond they just used em anyway. And forgetting to ask some people entirely.
No disrespect or hate, but if he was a good friend, he would have told the guy he was in the wrong and to fix the problem. Standing up for him doesn't help anything if he made a mistake. All it does is mask the problem. Hopefully the dude uploading at least learns his lesson.

I run a Reaction channel, so I absolutely get this. Before I even consider reacting to a video, I'll give it a few days to a week to get it's initial revenue and views, then I'll see if anyone else has reacted to it. If so, I do. If not, I ask the creators personally.
Plus, I'll never monetize the videos. Making money off of someone else's content is shameful...

As current law stands, I believe it does favor your position. Besides that, the law can be argued to be slowing progress by even allowing for arguments over someone making money off of other peoples work + a portion of their own. It is successful because there's demand for it.
I think you're referring to transformative work which is different. The videos aren't transformative - just reuploads.
