A lot of people have tweeted me this answer. Is it true that state and locals can make their own election rules, allowing non-citizens to vote or, for example (to make a point), babies?https://twitter.com/TadKolke/status/968228370898149376 …

I believe only federal. State and local can set their own rules.

How can you go into a voting booth AND ONLY select state/local during a federal election as well if you are illegal.? Hello........................

Yes. States have allowed non-citizens to vote in local elections, but not Federal. States do not control Federal election rules. I've fought it everywhere I've lived because it habituates non-citizens to voting in every kind of election. They won't be so careful about which.

2 towns in suburban DC - Garrett Park, MD and Takoma Park, MD, allow non-citizens to vote in their local elections only - not state or federal level. Garrett Park also proclaimed themselves a nuclear-free zone, so they will be safe when they drop the big one on DC

Not federal elections, but Chicago will fight to allow them to vote in the mid-terms, then not care that they'll lose the case eventually. I believe the state/local question is determined by state. Some Maryland town is preparing to let illegals vote in city elections.

Thats my thought. I seem to remember that we couldn't have Congressional term limits because states could not undermine federal election law.

States can expand the franchise but can't restrict it due to the 14th Amendment. So I think illegals can vote in non-federal elections.

The issue is what safeguards are taken that they don’t cast votes on federal ballots? Many state and local elections coincide with federal Election Day. I have no confidence that a state like CA adequately safeguards against non-citizens voting in fed elections.

There are no such safeguards. And most states issue drivers licenses to illegals.

If that’s the case, voters’ rights groups can sue thebstate for failure to implement safeguards required under Alien Voting 18 USC Section 611

No. Only citizens vote....period. States conduct the elections, they don't make the laws. They can't change the voting age for instance or ban women from voting.

Federal law doesn't prohibit non-citizens from voting in state or local elections, but no state has allowed it in state elections since Arkansas outlawed it in 1926. 11 local governments, 10 of them in MD, allow non-citizens to vote in local elections. https://en.wikipedia.org/wiki/Right_of_foreigners_to_vote_in_the_United_States …
