Sounds very clear cut when you put it that way, except that reality is not that simple. I think its a racist joke, but I don't think its racism, because I don't know if it represents an actual prejudicial stance. I can make a make a murder joke without being a murderer.

That's a criteria that can't be met because we can never get inside someone's head to know intent. It's possible to make a murder joke that's indistinguishable from a threat or incitement. Was it racism? All I can do is judge the effects of his speech, which I consider harmful.
