I'm a bit at a loss to explain to nonlawyers just how basic the subject matter of those questions is to what a federal judge does every day. Maybe "does a baker know the difference between whole wheat and white AP flour."

I generally hate this kind of terminological gotchaing. For example I'm pretty sure many Masters' in IR have been conferred to people who didn't learn the term nuclear triad. Many of them I'd still want to be president before Marco Rubio. However.

This is a job with specific professional qualifications and requirements (except unfortunately not officially). And this guy is explicitly proposing to get said job with none of those. Have at him. What an insult to the judiciary and the country to put this guy up there.

He's clearly intelligent, and honest if a bit bullshitty about his KSAs. He's probably a decent regulator at the FEC, I presume he knows that subject. But I'm with Sen. Kennedy here: unless he gets significant litigation experience, he should not get this appointment.

I have tried cases to verdict in US district court (won!) and I would be hesitant about accepting a nomination, TBH. I'm not a massive FRCP geek like I think you need to be. But I know what a Daubert motion is, for crying out loud.

I'm with Burt. This kind of questioning is a bit of a gotcha, but not knowing what a motion in lim is is so unbelievable that the rest doesn't matter.

There was nothing “Gotcha!” about any of those questions. That guy knew nothing. He has no business even thinking about accepting the appointment.
