In 2012 SCOTUS ruled the tax penalty was the only thing that made the ACA Constitutional. Mandating the Americans to purchase it w/o a tax penalty was Unconstitutional. Prex cond is if a person has a chronic illness before ins, doesn't apply to employer cvrg. Prex ins pools.
