No. Nielsen is wrong. The US must abide by the Geneva Convention. Asylum seekers do not break the law if they enter the US other than through a point of entry. Trump officials don't get to make up their own rules.

What does Sec. Nielsen mean when she says "We have to prosecute those who break the law"? Does she mean that she is legally obligated to break the law? What would the legal basis be for such a preposterous claim? 1/

There is no legal obligation to for the government to prosecute every known violation of the law. All governments exercise discretion in selecting those law violations that warrant prosecution. The rule of law does not mean that every violation of law has to be prosecuted 2/

When the government decides to prosecute all violations of a particular law it is doing so not because it has to do so, but because it has decided that there is a compelling reason to do so. 3/

So when Sec. Nielsen says that all illegal entrants will be prosecuted because the government has to, she's not being truthful. And she's being untruthful because she's trying to pretend that the decision to prosecute all illegal entrants wasn't a choice the admin. freely made 4/
