If those that seek asylum at our border aren't Mexican citizens, then it seems that they have already escaped their own country by the simple fact that they are in Mexico.

Then they are violating federal law. The law states that you must be on US soil to put in a claim for asylum. Also, according to law, you can be in this country for up to 1 year (legal or otherwise) to make your asylum claim.
