          2. Let’s accept for now that Brock was “under-sentenced” relative to non-sex crimes. Why does that mean Persky was wong? Maybe everyone else is for non-sex crimes?

          3. Real reform would mean looking at the Brock case and demanding equality via Brock-like terms for ALL, not for NONE. This is a persistent, historical failing with US punishment:

          4. In the way-old days, peasants were punished harshly, nobility far less so. Whitman (https://global.oup.com/academic/product/harsh-justice-9780195182606?cc=us&lang=en& …) has shown that as Europe democratized it treated all more like nobility. The US? Degrades all to peasants.

          5. The Persky Recall shows that our harshness-for-all instinct remains alive and well. Even putative liberals see that the only way to equate sentences is to make all equally harsh, not all equally light.

          6. This is bad policy, too. The data is clear: longer sentences don’t deter. And they likely incapacitate ineffectively as well. The money spent on tougher sentences could be far better spent elsewhere.

          7. It’s likely that this will lead to harsher outcomes as judges fear bad publicity. And since most defendants are poorer POC, the impact will be racially and class-wise skewed. The Turners of the world won’t pay the price.

          diificult to believe that — after so many decades and 1000s of cases demonstrating dramatically the fundamentally flawed nature of the US “justice” system — ANYONE could still believe that harsher sentencing and less judicial discretion is the answer to anything

          After reading this thread, I see that the Cary Nation of the Senate is at it sgain, swinging her axe with no consideration of the consequence. We Dems might lose the Minnesota Senate seat thanks to her, but at least Kirsten gets to ride her high horse into the sunset.
