Fun fact: "an order that has for its sole object a private end is unlawful..." US v Robinson, 20 CMR 63 (CMA 1955). Sounds a lot like bribery is unlawful....

If he is an active office, should he be court martialed for not obeying the chain of command?

No. Nothing he did violated the chain of command. You could argue that he might have leaked information that he should not have, but nothing presented in his testimony even hints at going around the chain of command. That is just GOP posturing to discredit him.
