Why do we arrest people and put them in jail before trials? We already put due process second.

There must be documented evidence against the individual to hold him or her, then a warrant issued. Mass assumption is anti-constitutional.

Point is constitution requires a warrant for arrest and confiscation. Detain for a few hours != arrest.

How many rights does one have while in handcuffs? Temporary is the whole point of the discussion in both examples. Are you arguing that the number of hours makes the difference?
