This will be interesting. Looks like a business exit strategy for Dominion. But that's just my opinion, which no one should take seriously.https://twitter.com/AP/status/1375405490813960193 …

BREAKING: Dominion Voting Systems has filed a $1.6 billion defamation lawsuit against Fox News, arguing the cable news giant falsely claimed in an effort to boost faltering ratings that the voting company rigged the 2020 election. http://apne.ws/Tm9qTcG

I haven't read the Dominion Voting Systems lawsuit against Fox, so I can't say too much about that. But I've read their complaint against Sidney Powell and it looks very strong.

I'm sure it is. But they might have a Pyrrhic victory ahead when FOX puts electronic voting in general on trial, which I assume they will.

      1) It is REALLY hard for a public figure to win a defamation lawsuit because you have to prove "actual malice."

      2) Assuming Dominion Voting Systems is ruled a public figure, the "actual malice" standard would require them to prove Fox knew they were lying or made false defamatory statements in reckless disregard for the truth. This is where I think they will make their stand.

Powell isn't using that defense. Would it not be equally available to her?

Looks like we crossed tweets. You would think she would use that defense. That is the normal defense for a defamation defense by a public figure. But as I said in my other tweet, I don't think it will work, so she is using the "Only an idiot would believe me" defense.

          1) Scott, I'm not a lawyer, but Joyce Vance is, and she makes a great observation about how Powell's defense could come into conflict with Fox's defense.https://twitter.com/JoyceWhiteVance/status/1375421586333925382 …

Dominion will have to prove Fox defamed then with “actual malice,” that Fox knew that the reporting was false or acted with reckless disregard to its truth. Should be interesting since Sidney Powell says everyone should have known her stories weren’ true. https://www.cnbc.com/2021/03/26/dominion-voting-sues-fox-news-for-1point6-billion-over-2020-election-claims.html …

          2) If the court buys Powell's defense that any idiot would know she was feeding them bullshit, then it will make it harder for Fox to claim they didn't know they were broadcasting lies when they aired her claims.
