Avoiding a trial in the senate because the outcome is fairly certain would be like failing to prosecute a murder because a conviction was unlikely. And in this case there’s no such thing as a plea-bargain.

Such a case would be equally tragic. And essentially all such cases would involve some consequences for the offender by way of plea-bargain.
