      Yes, prosecutorial discretion can be misapplied to non-POC. But it is systemically misapplied to POC, which is what @ScottAdamsSays says he is looking for.

      It is racial bias expressed through the US justice system. That system is meant to be equal for all, innocent until proven guilty. Racial bias should not be expressed in systems deliberately designed to treat everyone equally in punishment for equivalent crimes.

      Systemic, systematic, institutional, it's all the same fucking thing. If you are arguing definitions, you've lost the argument. None of it exists in the US. Name a single current example that can't be explained by simple individual racism.

      I'd call it racist judges and prosecutors. Unless black judges and prosecutors also discriminate against black defendants. Then I'd agree the "system" is defective.

          This is the missing context. Most misdemeanors carry very small sentences of only a few days but poor people take longer to bail out so their sentence includes weeks of jail credit already served before adjudication.
