There is no law that can or should eliminate prosecutorial discretion. You cannot legislate morality or ethics. Your gross oversimplification is why liberals have never come up with a solution.
We already do this all the time, they are called anti-discrimination laws. Denying service based on race is an ethical, moral issue and we outlaw the practice in a variety of different ways.
If you think legislating who you can serve a burger to is the same as legislating complex issues of discretion you are missing the point entirely.
Not at all related to the point you originally tried to make about legislating ethics and morality, and yes you absolutely can find ways to legislatively reduce the role of subjective discretion in sentencing decisions granted to prosecutors as agents of the state.
And those would be what...please explain. There is already constitutional protections prohibiting prosection based on race. You cannot, ever, force someone to be moral or ethical based on a law. If it worked there wouldn’t be murder or rape or most other crimes.
Sorry twitter is better suited to pointing out where legislation should be focused than actually writing out anti discrimination laws. You can’t really force anyone to do anything, but you can definitely codify punishments for doing things. Laws against murder etc do exactly that
That’s a cop out and frankly proof that you haven’t actually thought out what you are proposing. And again there already are civil rights laws in place which, according to you, have resulted in a colossal failure to POC. Which the evidence does not support.
I agree with you, civil rights laws as written do not provide sufficient protection from implicit bias being expressed in the US justice system. Yes the evidence clearly shows that POC are treated more harshly than whites by the US justice system for equivalent crimes.
When adjusted for income?
Yes, but even if not I don’t see how negative outcomes for low income people effects the injustice of other disparate negative impacts for POC relative to whites for equivalent crimes. We do already try to adjust for resource availability (6th amendmt) but could def do better
