You can find experts who will take opposite sides of nearly any argument. The evidence is presented to a jury ("the people") who decide if there is sufficient evidence to support the charge. And yes, it's designed so a guilty person will get off before an innocent is jailed.

When those mercs were caught in Venezuela recently, photos circulated of them cuffed and face down. Ed Calderon commented on it that they were at risk of positional asphyxiation. Maybe fentanyl played a role, even a significant one, but healthy people die in that situation.

Cops need to have some compassion once situation is under control. We are not our own enemies and no matter the situation this has to rule. Cops have ability to escalate or descalate if they choose.
