"In an emergency they can do whatever they want" is a recipe for a constant state of emergency, which is why it's fortunate that it isn't true.
Not sure what the law is currently, but Congress could certainly override state regulations for health care delivery across state lines. I suspect that the President already has the authority to do so under various emergency powers.
Congress could, if they wanted to, pass telehealth legislation that preempted state law, but they haven't.
Let's get a pledge from the ABA ambulance-chasers to leave participating physicians *alone*!
